These terms are an agreement between you and Awzany ("Awzany", "we", "us") for your use of the Awzany mobile app, the website at awzany.com and related services (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy policy. If you do not agree, do not use the Service.
1. Who can use Awzany
- You must be at least 16 years old, and old enough to enter into a binding agreement where you live.
- You must give accurate information when you create your account and keep it up to date.
- One person, one account. You are responsible for everything that happens under your account, so keep your password safe and tell us at once if you think someone else has used it.
- Coaches must be legally allowed to offer their services where they work and hold any licence or insurance their work requires.
2. Health and safety: not medical advice
- Awzany, including Wazangy and any AI feature, gives general fitness and nutrition information. It is not medical advice and does not replace a doctor, dietitian or physiotherapist.
- Talk to a qualified health professional before starting a new training or diet programme, especially if you are pregnant, have a medical condition or an injury, or take medication.
- Stop exercising and seek help if you feel pain, dizziness or shortness of breath.
- AI answers can be wrong or incomplete. Use your own judgement, and never ignore professional advice because of something the app said.
- Your health profile is self-reported. Awzany does not verify it.
- You train at your own risk, within your own limits.
3. Your account and the app
- We give you a personal, non-transferable, revocable licence to use the app for your own use.
- Some features need an internet connection, a minimum app version or your permission (for example camera, location or notifications).
- AI features have usage limits and may change.
- We may update, change or stop features. When a change materially reduces what you can do, we will try to tell you in advance.
4. The coach marketplace
Awzany connects trainees with independent coaches. Coaches are not employees or agents of Awzany, and Awzany is not a party to the coaching relationship. Each coach is responsible for the training they provide, for their own conduct and for complying with the law.
For coaches
- Your coach page, offers, prices, availability and certificates must be accurate. Only list qualifications you actually hold.
- Verification badges mean we checked an ID or a certificate at a point in time. They are not a guarantee of quality or a recommendation by Awzany.
- You set your own prices, packages, promotions and free-cancellation window, within the limits of the app.
- You must deliver the sessions you accept, at the agreed time and place, and mark them correctly (done or no-show). Marking sessions you did not deliver is fraud.
- Do not ask trainees to pay outside Awzany for bookings made through Awzany, and do not use the platform to collect trainees and then move payment elsewhere.
- Awzany may hide a coach page that breaks these terms, with a reason, and may suspend the account.
For trainees
- Read a coach's page and offers carefully before booking. Choosing a coach is your decision.
- Arrive on time, follow the coach's safety instructions and tell them about any health issue that matters for training.
- Anything you arrange with a coach outside Awzany, including payments, is between you and the coach and is not protected by Awzany.
5. Bookings, escrow and cancellations
- Paying: when you book an offer or request a custom offer, the price is taken from your Awzany wallet and held in escrow until the booking ends. If the coach declines, or nobody answers within the answer window (48 hours by default), the full amount returns to your wallet.
- Negotiation: either side can accept, decline or propose new terms (price, sessions, validity and times) for a limited number of rounds. If a counter-offer raises the price, the difference is paid up front.
- Sessions: after the coach marks a session done, the trainee has 48 hours to report a problem. Otherwise the session completes and its share of the price is released to the coach, less the Awzany fee.
- Cancellations: cancelling a session before the coach's free-cancellation window (6, 12, 24 or 48 hours before it) is free. A later cancellation, or not showing up, counts as a session delivered and is paid to the coach. Cancelling an active booking refunds the unused sessions. Sessions not used by the end of the booking's validity are paid to the coach.
- Disputes: a reported problem puts the session on hold. The Awzany team reviews what both sides tell us and decides to refund the trainee or pay the coach. Our decision on the money held in escrow is final within the Service; it does not limit any rights you have under the law.
- Fees: Awzany charges coaches a platform fee as a percentage of the booking price, shown before they accept a booking. We may change the fee for future bookings with notice; accepted bookings keep the fee shown when they were accepted.
6. The wallet
- The wallet holds money you add to pay for bookings, and money coaches earn. It is not a bank account, does not earn interest and is not a payment card.
- Top-ups: you send money by InstaPay or bank transfer to the details shown in the app and upload proof. We add it to your balance after we check it. We may reject a top-up we cannot match, or that looks fraudulent; the money is returned where possible.
- Withdrawals: you can withdraw your available balance to an InstaPay address or bank account in your own name. A transfer fee may apply and is shown before you confirm. We may ask for more information before paying, and may hold a withdrawal while we look into suspected fraud or a dispute.
- Mistakes in the payout details you enter are your responsibility. Tell us at once if you notice one.
- If we credit your wallet by mistake, we may correct it.
- We may close a wallet that is used for fraud, money laundering or anything illegal, and report it where the law requires.
7. Your content
- "Your content" means what you put into Awzany: workouts, logs, photos, profile details, coach pages, messages, reviews and anything else.
- You keep ownership of your content. You give Awzany a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and process it only to run, protect and improve the Service, and to show it to others as your settings allow (for example a public coach page on awzany.com or in search engines). The licence ends when you delete the content or your account, except where others already received it (for example messages you sent) or we must keep it by law.
- You confirm you have the rights to the content you upload, including photos of other people, who must have agreed.
- We may remove content that breaks these terms or the law.
8. Acceptable use
You must not:
- harass, threaten, bully, impersonate or discriminate against anyone;
- post sexual content, hate, violence, or content that exploits minors;
- share someone else's private information without their permission;
- sell or promote illegal or dangerous substances, including steroids or unprescribed medication;
- give false information, fake reviews, fake certificates or someone else's ID;
- spam, advertise unrelated services, or run scams;
- cheat the leaderboards, for example by logging workouts you did not do;
- try to break, overload, reverse engineer or scrape the Service, or get around its security, limits or captcha;
- use the Service to break any law.
9. Suspension and termination
- You can stop using Awzany and delete your account at any time from the app.
- We may suspend or close an account, hide a coach page or remove content if you break these terms, if we must by law, or to protect other users. Where it is safe and lawful, we will tell you why and how to reach us.
- When an account is closed, active bookings are cancelled and unused amounts are refunded to the trainee, and any remaining wallet balance that is lawfully yours is paid out to you after open disputes are resolved.
- Sections that by their nature should survive closure (such as payments owed, disclaimers and liability) continue to apply.
10. Intellectual property
The Awzany name, logo, app, website, design and the content we create are owned by Awzany or our licensors. Except for the licence in section 3, these terms do not give you any right to use them. Feedback you send us may be used without obligation to you.
11. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we do not promise that it will be uninterrupted, error-free or that results (such as strength gains or weight changes) will follow. We do not guarantee the quality, safety or legality of any coach's services, or the accuracy of AI answers, exercise demos or nutrition estimates.
12. Limitation of liability
To the extent the law allows:
- Awzany is not liable for indirect, incidental, special or consequential losses, or for loss of profits, data or goodwill.
- Awzany is not liable for injuries or losses caused by training, by a coach's services or by advice from AI features, except where caused by our own negligence.
- Our total liability for any claim about the Service is limited to the greater of the fees you paid to Awzany in the 12 months before the claim, or 1,000 EGP.
Nothing in these terms limits liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.
13. Indemnity
If you break these terms or the law, or a claim arises from your content or, for coaches, from the services you provide, you agree to cover reasonable losses and costs Awzany suffers as a result, to the extent the law allows.
14. Changes to these terms
We may update these terms. We will change the version date at the top and, for significant changes, ask you to accept the new version in the app before you continue. If you do not accept, you can delete your account.
15. Governing law and disputes
These terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-law rules. Before going to court, please contact us so we can try to resolve the issue informally. Any dispute that cannot be resolved this way will be handled by the competent courts of Cairo, Egypt, unless the law of your country gives you the right to bring a claim where you live.
